Purchases

Single-family residential home purchase 

 

$1,895.00

 

INCLUDES:

  • Lawyer's fee for services

  • Disbursements* (including all searches, registering your Deed and one Mortgage, mailing, copying, courier, faxes)

  • HST

* The only disbursements not included in this figure are:

 

(a) Your title insurance policy. For example, for properties up to $500,000, the policy is $459.00. Policies cost less for condominiums. Please refer to stewart.ca for useful information regarding title insurance and the invaluable protection it provides to you.

 

(b) Land Transfer Tax. This is a tax levied by the Ontario government when you buy a home, and it is based solely on the purchase price of the home you are buying. First-time home buyers may qualify for a waiver of the Land Transfer Tax. Please refer to http://www.fin.gov.on.ca/en/tax/ltt/ for useful information regarding Land Transfer Tax.

 

(c) any additional registrations beyond your Deed and one Mortgage, if applicable (e.g. second mortgage, Deed Restrictions, Power of Attorney, etc.).

 

(d) a survey of the property if your mortgage company requires one (almost all waive with title insurance) or you desire one.

 

(e) Any off-title searches (e.g. building department, fire department, etc.) waived by the title insurance provider but desired by the client.

This price is based on a policy of title insurance being purchased on your behalf to protect your rights to the property. Failure to purchase a policy of title insurance will result in additional fees, disbursements & HST.

Please note that the PST on your CMHC premium (if applicable) is an out-of-pocket expense on your part on closing. Please inquire with your mortgage broker in that regard. Please note that you may also owe the Vendors of your property additional money on closing if they or their mortgage lender have prepaid the municipal property taxes past the closing date of your purchase.

Sales

Single-family residential home/condo sale

 

$895.00

 

INCLUDES:

  • Lawyer's fee for services

  • Disbursements* (including faxing, mailing, copying, couriers and the Law Society Transaction Levy Surcharge)

  • HST

*The only fees and/or disbursements not included in the above figure are:

 

(a) any applications to, for example, The City of Windsor, or an Ontario Court, should same be necessary to complete your transaction (e.g. for a minor variance or severance, discharge of old mortgage, etc.);

 

(b) obtaining a current or existing survey of the property if one was promised to the Purchasers by you in the Agreement of Purchase and Sale, and you do not have one in your possession;

 

(c) Tax Certificate, if the client is unable or unwilling to provide up-to-date property tax information in their possession or obtain written confirmation from the municipality itself and provide the same to this office, for the purpose of preparing a Statement of Adjustments;

 

(d) Any Estate work which may be required in order to complete your transaction e.g. including but not limited to, if the registered owner has died and probate must be obtained to convey title.

(e) If the sale is the result of a marital dissolution

(f) If any of the Vendors are non-residents of Canada

(g) registration of any documentation to correct or amend title ($85.00 each)

Refinances

Single-family home/condo mortgage refinance 

 

$1,495.00

 

INCLUDES:

  • Lawyer's fee for services

  • Disbursements* (including all searches, mailing, copying, courier, faxes)

  • HST

  • The $85.00 government charge for the registration of your new first mortgage

* The only disbursements not included in the above figure are as follows:

 

(a) the $85.00 government registration cost for each additional document(s) that may in limited circumstances be required to complete your transaction e.g. including but not limited to: registration of an Application to amend your name on title in the event you have married or changed your name since acquiring the property, discharge of your current mortgage if your existing lender does not include the $85.00 in their discharge fee, any documents required to correct your title (if necessary), registration of Deed if removing/adding someone onto title at same time, Power of Attorney (if applicable). Please feel free to contact my office by email at your convenience should you have any questions as to whether any of these additional documents may be required in your particular situation.

 

(b) Policy of title insurance for the mortgage lender. The cost is typically $183.60.

 

(c) Tax Certificate, if the client is unable or unwilling to provide up-to-date property tax information in their possession or obtain written confirmation from the municipality itself and provide the same to this office;

 

(d) Land Transfer Tax (if payable as a result of someone being removed from title at the same time);

 

(e) Status Certificate on condo refinance, if the mortgage company insists upon one (almost all waive with title insurance).

 

Additional fees may be applicable if there are any collections to be paid out from the mortgage proceeds, or if the mortgage is being given to secure a business loan.

 

Additional fees and disbursements will apply if:

  • One or more additional parties, who will not be residing in the premises, are signing the mortgage as mortgagors or guarantors

  • A search of writs reveals one or more matching/similar name executions against the Mortgagor(s)

  • Your closing date is delayed or amended past the original closing date.

  • The property you are mortgaging is registered in both the Registry and Land Titles system (dual registration)

  • The property you are mortgaging is subject to a contract related to a solar panel installation

  • Any Mortgagor is signing documents by way of Power of Attorney

  • Your new mortgage is with Canadian Western Trust Company, First National Financial, Home Trust Company, Bridgewater Bank or Haventree Bank.

  • There are more than two Mortgagors.

  • The new mortgage is going into any positions other than as a 1st mortgage on title.

  • Multi-unit dwellings: Please contact my office at your convenience to receive a customized quote for the refinance of a multi-unit dwelling

Additional fees will be applicable if there are any private (i.e. non-institutional) mortgages on title to be paid out and discharged.
